The report indicated that Conover had stopped and used his horn to bring attention to himself, and that he was unable to see Hamilton. In addition, the report states that Hamilton was wearing dark clothing and riding his bicycle with no illumination.

The Island Packet reports that the suit, which was filed on April 27, 2017, contends that “Defendant Conover owed the Plaintiff a duty of care to operate his vehicle in a safe and prudent manner….Plaintiff has suffered injuries that have caused, and may in the future cause, Plaintiff to incur one of more of the following elements of damage: a. physical pain; b. suffering; c. loss of enjoyment of life; and d. medical expenses.”

The damages that Hamilton is seeking is unknown. However, in order to file in this particular court, the request has to be a minimum of $7,500.
