More details are beginning to emerge about exactly what happened in the home of Nick Gordon and Bobbi Kristina Brown on the day that Bobbi was found unconscious and face down in her bath tub and was later rushed to the hospital where she still remains. The latest information comes from the attorney for Nick and Bobbi’s friend Max Lomas, who was in the house at the time with his girlfriend and Nick, and is the one who reportedly discovered Bobbi. His attorney Ashleigh Merchant tells E! News that it was a visit from an Xfinity cable technician that eventually led Max to find Bobbi.

Merchant says Nick Gordon “was actually the one who answered the door for the cable man, and he was showing the cable man around.” As Nick was doing that, Max Lomas went looking for Bobbi Kristina. Max “says that he knocked on her door and he didn’t get an answer, so he went in and checked on her to see how she was doing.”

After Max discovered Bobbi in the tub, “he called for Nick, screamed for Nick, and then he immediately called 911,” Merchant says.

“It seems like it might’ve been 10 or 15 minutes that she must have been alone… but we don’t know at what point she actually ended up in the tub during that time,” Merchant added.

Merchant added that her client has been cooperating fully with authorities and is not considered a suspect, a point that she also made in a statement issued on Wednesday:

It is our understanding that Mr. Lomas has cooperated with the authorities investigating what happened involving his dear friend, Bobbi Kristina Brown. Mr. Lomas is deeply concerned for Ms. Brown and remains hopeful for her full, complete and swift recovery. Mr. Lomas’ widely reported recent arrest is completely unrelated to the incident that occurred at Ms. Brown’s residence and there is absolutely no relationship between the two events. He has pleaded not guilty to those charges. Mr. Lomas has not been accused of anything in connection with Bobbi Kristina Brown’s injuries and is a witness in this investigation. Mr. Lomas’ main focus is on Ms. Brown’s full recovery and he continues to pray for her and her entire family throughout this tragedy.

Max’s “widely reported recent arrest” was from January 14 (mug shot photos above) when he was arrested and charged with three felonies, including possession of a firearm, possession of marijuana with intent to distribute, and possession of alprazolam (aka Xanax). Police found the drugs and the gun after being notified by the mother of Danyela Bradley that Max (full name Maxwell Byron Lomas) was holding their daughter against her will. Danyela told police that accusations were untrue, but police discovered the drugs and gun and Max was arrested. He has pleaded not guilty.

Max was also previously involved in a bloody altercation involving guns back in April of 2011. According to The National Enquirer, the police report from the incident indicates that Bobbi Kristina was with three men in a vehicle when Max Lomas and Nick Gordon approached and began punching a man named Justin Walls, who was sitting in the front passenger seat. Meanwhile, Nick waved a Glock19 handgun around in an effort to intimidate the other men in the car.

And in another incident from June of 2011, Max (who had a mohawk at the time) and four others were arrested after police searched the truck they were sitting in parked in a forest in Dawson County, Georgia and found three rifles and a large amount of marijuana. Max was charged with possession of marijuana with intent to distribute, possession of firearms during commission of a felony, and consumption of alcohol in a park.
