90 DAY FIANCÉ Patrick’s motion accusing Thais of an affair stricken by judge
A Nevada District Judge has stricken the motion filed by 90 Day Fiancé star Patrick Mendes alleging his wife Thais Mendes had an affair prior to their separation in May.
As Starcasm was the first to report, Patrick filed a motion last week in his divorce case in which he stated Thais had an affair that he learned about in April. He also claimed in the motion that Thais “grabbed a knife and threatened” him with it “all while holding” their daughter Aleesi.
Below are excerpts from Patrick’s filing from our previous post. (The filing awkwardly referred to Patrick and “Dad” and Thais as “Mom” throughout.)
“On or about April 11, 2026, Dad learned that Mom was involved in an affair,” reads a motion filed by Patrick’s attorneys on Wednesday.
The filing also reveals details about what happened between Patrick (Dad) and Thais (Mom) after he became aware of the infidelity.
“After Dad discovered the affair, Mom demanded that Dad move out of the Parties’ home, as she had told her new romantic partner that the Parties were already separated and no longer residing together.”
Apparently Patrick was reluctant to relocate. “Mom thereafter made threats to Dad – leading Dad to officially move out of the marital residence on or about May 6, 2026.”
A little more than two weeks later, Patrick and Thais got into the altercation that resulted in her arrest for domestic battery.
“On May 22, 2026, the Parties got into an argument that led to Mom getting violent with Dad,” the motion states. “During that incident, Mom grabbed a knife and threatened Dad with it, all while holding the Child.”
After news about the allegations in the filing broke, TMZ spoke with Thais’s attorney, Carmen Marisol. She said the affair claim was inaccurate, adding that Patrick’s attorneys acknowledged the inaccuracy and admitted the allegations “were included in error.”
Marisol told TMZ she and Patrick’s legal team had agreed to strike the motion.
JUDGE STRIKES PATRICK MENDES’ MOTION WITH AFFAIR CLAIM
Starcasm can confirm Thais and Patrick’s attorneys were in agreement about striking Patrick’s motion, and a judge did just that on Wednesday.
Patrick’s lawyers filed a stipulation and order to strike their previous motion that included the following explanation:
IT IS HEREBY STIPULATED that Plaintiff’s Motion for Joint Legal and Joint Physical Custody of the Child, for a Set Custodial Timeshare, for Child Support, for Attorneys’ Fees and Costs, and for other Related Relief (Doc ID# 19), filed on August 19, 2026, shall be withdrawn and stricken from the Court record due to the disputed allegations contained therein that have since been resolved between the Parties.
A paralegal from the law firm representing Patrick sent the proposed stipulation and order to Thais’s lawyer, Carmen Marisol, on August 21. Carmen replied three days later with her approval.
The judge in the case approved the stipulations on Wednesday.
Patrick and Thais mutually agreed to participate in Family Mediation Center services in hopes of reaching an agreement. They are due back in court on October 27.
