The lawsuit between Josh Duggar and Danica Dillon won’t be heard in court for another couple of weeks, but attorneys for the fallen Duggar star are doing everything they can to challenge Dillon in the court of public opinion beforehand. Duggar’s legal reps went on the offensive this week, calling the Danica Dillon lawsuit a lie and filing a motion to have it dismissed before the two parties even meet.

The timeline in the ongoing Josh Duggar and Danica Dillon drama is this. Dillon, an adult film actress and exotic dancer, outed herself as one of Duggar’s mistresses last summer, in the wake of the Ashley Madison hacking scandal. She described their paid sexual encounter as very violent, claiming that Josh threw her around like a rag doll. A few months later, after Josh had entered treatment for sex addiction, the Danica Dillon lawsuit made headlines the world over. The civil suit asks for $500,000 from Josh Duggar, for what Dillon claims amounted to sexual assault. Among other things, the lawsuit states that Dillon “felt as if she were being raped by the Defendant.”

Since Josh Duggar and Danica Dillon became joined by Dillon’s lawsuit, both parties have remained relatively silent on the matter, though recent speculation has mounted on the matter of whether Dillon’s civil case could, potentially, become a criminal one. Legal scholars noted in several reports that there is precedent for such a thing, depending on what the civil investigation turns up; one observer suggested a possible ten- to twenty-year charge for Josh Duggar–again, depending on what investigators find, and whether the District Attorney is willing to pursue such a case.

Which might be a big part of why the Duggar family is trying to get the lawsuit thrown out before attorneys for both parties meet in judge’s chambers on January 21st. Josh Duggar’s lawyers say Dillon hasn’t been able to produce enough evidence to prove that the sex was as violent as she claims, and, when that argument failed to move the judge, the lawyers apparently produced “a one-hundred page” alibi in order to prove that Josh Duggar was not in the state of Pennsylvania on the nights in question. Finally, Duggar’s legal team has argued that the Danica Dillon lawsuit is merely a cash grab, given the fact that Josh was a public figure, and, by their logic, the fact that he was “nowhere near” Pennsylvania at the time the alleged incidents took place.
