VIDEO The Old Navy Super C-U-T-E commericial that sparked a Kim Kardashian lawsuit

Model Melissa Molinaro stared in the Old Navy ad

Kim Kardashian, who has built an epic empire from a sex tape, a large, shapely rear, and relentless self-promotion, is suing Old Navy (or rather it’s parent company The Gap) over an advertisement featuring a dark-haired model who sort of looks like her. There appears to be some homages to Kim’s look, style, and shapely appearance, but it doesn’t seem worthy of a lawsuit. For starters, this chick is singing, and we all know Kim may be many things, but she’s not a pop star.

Melissa Molinaro does look like Kim, and she was definitely styled to look like Kim, but does that mean that no one has the right to “play around” with the images of pop culture icons?

The suit, which Old Navy says it hasn’t seen yet, states Kim “has invested substantial time, energy, finances and entrepreneurial effort in developing her considerable professional and commercial achievements and success, as well as in developing her popularity, fame, and prominence in the public eye.”

The Super C-U-T-E commercial began airing in February, and has racked up over 2 million Youtube views. In a twist to this lawsuit, the model in the ad spot, Melissa Molinaro, has been dating Kim’s ex Reggie Bush (this isn’t the first time Reggie’s dated a girl that looks like Kim.) Could there be more personal reasons behind this lawsuit?

UPDATE: Kim was also defending The Kardashian’s endorsement deal with Sears.
