Shotgun mom will not be prosecuted, man who survived break in charged with first-degree murder

Sarah McKinley from Blanchard, Oklahoma will not face any prosecution for shooting, and killing, Justin Shane Martin whom cops allege was attempting to break into her mobile home with a knife.

Sarah’s amazing story exploded across the news wire yesterday. If you missed it, Sarah’s home was being invaded by two men. She grabbed her shotgun (and later a pistol too), calmed her 3-month-old baby son with a bottle and called 911. For over 20 minutes these two men worked at getting in through the front door which Sarah had barricaded with her couch.

While on the phone with the 911 dispatcher she asked if she had the right to shoot if the intruders were to break in. The dispatcher said she couldn’t flat out say that but did suggest that she do what she needed to do to protect her baby. When Martin finally made it in, Sarah shot him dead.

What made Sarah’s story even more incredulous and sad was the fact that her husband had passed away on Christmas day from cancer.

The invasion and shooting all went down on New Year’s Eve and the authorities have acted quickly in their investigation. They have concluded that Sarah committed no crime and that she will not face prosecution. The surviving intruder, Dustin Louis Stewart (above mug shot), was booked on charges of burglary first-degree, but now he’s facing first-degree murder charges.

Assistant District Attorney James Walters said:

“When you’re engaged in a crime such as first-degree burglary and a death results from the events of that crime, you’re subject to prosecution for it.”

Stewart initially fled the scene but later turned himself in. According to court documents, Martin and Stewart might have been looking for prescription drugs.
