Kim Zolciak asks court to drop Kandi Burruss’ “publicity stunt” lawsuit against her

The latest shot in the “Don’t Be Tardy for the Party” war has been fired as Kim Zolciak files legal documents asking the court to drop Kandi Burruss’ lawsuit against her. Kim is claiming Kandi filed the lawsuit as a way to draw publicity for her new spin-off show, The Kandi Factory, which premiered on Bravo on April 9th. (Of course, if it is a publicity stunt, then Kim stands to gain as well because her spin-off, Don’t Be Tardy…, has its season premiere tonight — just before The Kandi Factory.)

Kim is claiming Kandi was paid in excess of $23,000, which was $6,000 more than she was owed, according to TMZ. Those numbers contradict Kandi’s claims that she was only paid $4,000 total for her work on the song.

Kandi also denies that the suit is a publicity stunt, insisting that taking legal action against Kim was the only way she could get the digital music distribution service, TuneCore, to take the song down. (Click here for Kandi’s explanation of why she waited so long to file the suit.)

The topic wasn’t discussed during the Reunion Special, reportedly due to legal reasons, but Kim will be on Watch What Happens Live tonight, and you can bet she’s going to be asked about it! I wouldn’t get too excited, however — I predict she is going to plead the fifth and say her lawyer told her not to discuss the case.

So far, the other cast member of The Real Housewives of Atlanta with a spin-off series, Phaedra Parks, has remained relatively silent in the matter, even though she is reportedly Kandi’s attorney. Perhaps Phaedra will throw her bonnet in the ring when her show (tentatively titled Rich People’s Problems) premieres later this year.

The K&K Bravo bonanza begins with the premiere of Don’t Be Tardy… tonight at 9/8c, followed by The Kandi Factory at 10/9c, and concluding with Watch What Happens Live (with Kim Zolciak) at 11/10c.
