The Real Housewives of New York City star Countess Luann de Lesseps got a little bit of good news today as prosecutors opted to not pursue three of the four felony charges the reality star was facing stemming from her December 23 arrest in Florida after an alleged drunken assault of a police officer.
Palm Beach County prosecutors will drop the felony count of battery of a law enforcement officer as well as the two felony counts of corruption by threat. According to online records, they will officially charge the Countess with a felony count of resisting an officer with violence as well as misdemeanor charges of trespassing and disorderly intoxication on Thursday morning.
The news follows the Countess entering a not guilty plea and request for a jury trial on December 29. Two days later, Luann announced she would be checking herself into an alcohol treatment program. She has since returned home to New York city where she was recently photographed with her RHONY co-stars at a restaurant:
While researching Luann’s court case I was able to obtain the original arrest report, so I decided to post the arresting officer’s account of what happened in its entirety:
On Saturday December 23, 2017 at approximately 2118 hours, I was dispatched to the Colony Hotel at 155 Hammon Ave., Room 407, Palm Beach FL, in reference to an intoxicated female. Upon arrival, I met with the hotel security guard, Carlos Lopez (H/M, DOB: 10/30/73), who stated that the intoxicated female was trespassing in someone else’s room, room 407. Lopez advised he had given multiple verbal warnings to the female to vacate the room, to which she still refused. Lopez stated that the female’s assigned room was number 327, however she and a male were in room 407 refusing to leave. Lopez stated that he was notified by housekeeping that the female and male entered room 407 while she was completing a turn down service. Lopez further stated that he made entry into room 407 and found the male and female in the bed at which time he told both occupants they needed to vacate the room and return to their assigned room. After multiple attempts to get both subjects to leave over a five minute period, he contact the Palm Beach Police Department.
When Officer O’Leary and I arrived on scene, room 407, we met with two females occupying the room, later identified as Luann De Lesseps (W/F, DOB: 05/17/65), and her friend Julie Olson (W/F, DOB: 2/27/64). It should be noted that both smelled of an unknown alcoholic beverage, had slurred speech and appeared to be highly intoxicated. I asked both females to exit the room, Olson left however De Lesseps refused to leave, and locked herself in the bathroom. De Lesseps was told several times to come out of the bathroom, and leave the room however she still refused. When Lopez attempted to open the bathroom with a key, De Lesseps opened the door. Officer O’Leary then attempted to detain De Lesseps and remove her from the bathroom, at which time De Lesseps shoved Officer O’Leary with an open palm to the chest, then slammed the door on Officer O’Leary face, striking him in the forehead. While De Lesseps was being placed in handcuffs she resisted by pushing and pulling away from Officer O’Leary and I.
While De Lesseps was in the back of my patrol car, she slipped out of her hand cuffs, and attempted to exit the vehicle. De Lesseps was removed from the back of vehicle so I could re-secure the handcuffs on her wrists. During this time she resisted again by pushing and pulling her arms away from me. As I was placing De Lesseps in the back into the vehicle, she stated “I’m going to f**king kill you,” and tried kicking the door to keep it from closing. De Lesseps had to be physically placed in the seat to secure her seatbelt and close the door. Once De Lesseps was transported back to the Palm Beach Police Department and placed in a holding cell, she stated again that she was “going to f**king kill all of you” to Officer O’Leary and I multiple times.
Based on the facts above I arrested and charged Luann De Lesseps with Battery on a LEO pursuant to F.S.S. 784.07(2B), Resisting with Violence pursuant to F.S.S. 843.01, Corruption by Threat pursuant to F.S.S. 838.021(3B), and Disorderly intoxication pursuant to F.S.S. 856.011.
I would guess that Luann’s lack of any serious priors combined with her having the money to afford a decent attorney will result in no jail time, but I would be remiss if I didn’t mention that the felony count of resisting an arrest with violence does carry a maximum sentence of five years.
I couldn’t find a new court date, but I imagine that will be announced after charges are officially filed Thursday morning
