Kelly Rutherford and Daniel Giersch with son Hermes in happier times
Kelly Rutherford has been granted a 21-day restraining order against her recent ex-husband Daniel Giersch. Rutherford divorced Giersch while she was still pregnant with their second child, Helena. Her current restraining order is not just to keep Giersch away from herself and the children, but also her mother and her nanny. Rutherford says Giersch has threatened the nanny with a lawsuit and harassed her until she quit. (via PopEater)
According to E! Online, the Gossip Girl star also cites her diminished breast milk output on Daniel’s stressful impact on her life. Their divorce has been particularly messy, with each firing insults and accusations meant to undermine the other’s parental rights to their two children. Giersch has claimed that Rutherford is violent and an unsuitable mother, but for how he must stay 100 yards away from her and her family “except for brief and peaceful contact as required for court ordered visitation.”
Of course, Giersch’s lawyer has now released a statement calling Rutherford’s recent description of Giersch’s actions “fiction.”
