Read the complete Probable Cause Affidavit detailing the arrest of Anna Kournikova’s mother Alla Kournikova.

Police arrived at Alla’s Palm Beach home Tuesday afternoon after a neighbor found her five-year-old son Allan Kournikova wet and bruised in the front yard. The boy told the neighbor and eventually police that he had jumped out of a second story window before getting in the pool because his feet were hurting after the fall. It was later determined Alla Kournikova had left her son in the house to run to the bank and the post office. All the doors were deadbolted with a key and the windows were all painted shut on the first floor. Alla stayed gone for more than fifty minutes, during which time Allan jumped from the second-story roof approximately 15 feet above the ground.

On Tuesday January 19, 2010, at 13:58 hours, the Palm Beach Police Department received a call that a passerby had found a 5-year-old white male walking in front of the residence at 211 Seabreeze Avenue, Palm Beach Fl 33480. The caller was standing by with the child and advised that the boy was soaking wet and he was very upset. The caller further advised that the child said he had jumped out of a window.

Officers arrived on scene at 1401 hours and met with the reporting party and a child who stated his name was [deleted]. [deleted] told officers he jumped out a second story window, then went to the pool and jumped in because his feet hurt. A check of the residence found that the boy jumped off a second story roof that was approximately 15 feet high and landed in a white stone side yard between two air conditioning units. The child stated he hung by his hands before letting go, and that he then walked walked through a black fence and entered the pool. His feet hurt because he was bare foot when falling onto the stones. Palm Beach Fire Rescue responded for a medical check of the child.

Officers were unsure if any other individuals were inside the residence and based on the state of the child attempted to enter the residence. They found all the doors locked with a deadbolt. They located a ladder and made entry to the residence via a second story roof that leads to the house. At the top of the ladder they located a open second story window that lead to a child’s playroom. They searched the house for any occupants, evidence of foul play or possible crime victims. They found none and attempted to exit the residence. They were unable to exit the residence as all the doors were locked with a key type deadbolt lock. All the windows were painted shut or shuttered and they could not exit on the first floor. They were forced to exit the residence via the same ladder.

During this process, numerous attempts were made to contact the homeowner, Alla Vadimirovna Kournikova. At approximately 1436 hours Capt. Frick was able to locate a cell phone number for Kournikova. The call was not answered and a voice mail was left. At approximately 1445 Kournikova returned to the residence. At that time, the circumstances surrounding the incident were explained. Upon my arrival, a preliminary interview was conducted with Kournikova and she was presented with a consent to search form which she signed.

Kournikova returned to the police station for an interview at which time she was read her Miranda rights from a prepared card. Kournikova understood her rights and signed the card. At that time, she stated that the child was awake and sitting on the couch watching television at the time she left the residence, and that he did not want to go with her to run errands. She advised she deadbolted the residence and left him with a phone. She stated that she left at approximately 1340 hours to go to the bank and post office. After leaving the post office she noticed the voice mail left by Capt. Frick and returned to her residence. The only key left in the residence to unlock the door was on top of the refrigerator. This interview was recorded.

Kournikova knowingly left her five-year-old son in her residence unsupervised for in excess of 50 minutes. The boy exited the residence through a second story balcony window and jumped 15 feet to a crushed stone walkway. He then entered the pool in the back yard and subsequently walked out of the front yard to the sidewalk which is adjacent to Seabreeze Avenue. Kournikova failed to provide the necessary supervision to maintain the child’s physical well-being. At the time of this writing, the child had bruising about his feet and lower back as a result of the fall from the second floor. Kournikova is the child’s mother and primary care giver.

Based on the above stated facts, there is probable cause to charge Alla Kournikova with one count of Neglect of a Child FSS 827.03(3)( c) a third degree felony.
