Tracy Morgan fires back at Wal-Mart’s criticism in ongoing lawsuit

Ailing comedian Tracy Morgan, whose attorney says he is “struggling every day, fighting hard just to get incrementally better” in the wake of his car crash and hospitalization this summer, has spoken out against retail giant Wal-Mart.

Specifically, Morgan takes issue with the claim Wal-Mart’s lawyers recently filed in the lawsuit Morgan has brought against their employer: that the injuries Morgan and fellow passengers suffered when a Wal-Mart semi-truck smashed into their stopped limousine “were caused, in whole or in part, by plaintiffs’ failure to properly wear an appropriate available seatbelt device.”

To that, Morgan replied:

 

After I heard what Wal-Mart said in court I felt I had to speak out. I can’t believe Wal-Mart is blaming me for an accident that they caused. My friends and I were doing nothing wrong.

 

And his lawyer, Benedict Morelli, backed him up, stating that Morgan’s limo was “at a dead stop” when it was rear-ended by a truck moving at 65 miles per hour.

“The driver never braked, never swerved,” said Morelli; “Seatbelts had nothing to do with it.”

Kevin Roper, the truck driver responsible for the crash, has been charged with vehicular homocide, along with assault by automobile.

Meanwhile, Morgan–along with the two other people in the limo at the time, Jeffrey Millea and Ardley Fuqua–suffered brain trauma in the wreck, and do not remember it.

Morgan is even unsure if he’ll be able to resume his acting and stand-up career.

According to Morelli, Morgan has been offered both his own television show and a starring role in a movie…but is unable to commit to any projects of any kind until he’s healed.
