According to multiple sources, actress Reese Witherspoon and her husband Jim Toth were both arrested in Atlanta Friday after Toth was pulled over for DUI and Reese got a little too upset with the cops about it.
Toth was reportedly pulled over after midnight on Friday after an officer saw the silver 2013 Ford Focus he was driving weave across a double line on Peachtree St. According to a police report obtained by Variety, Toth appeared disheveled and his breath smelled of alcohol, prompting the officer to administer a sobriety test in a Walgreens drug store parking lot.
As police were administering the sobriety test, Reese Witherspoon remained in the car — for as long as she could. “Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer,” the police report states. “I told Mrs. Witherspoon to sit on her butt and be quiet,” was the officer’s reply.

When Toth, 42, was placed under arrest after blowing .139 on a Breathalyzer test, Witherspoon, 37, got out of the car. An officer instructed her to get back in the vehicle, and she “stated that she was a ‘US citizen’ and that she was allowed to ‘stand on American ground,’” according to the report.

The officer then detailed how she resisted as he grabbed her arms to arrest as Toth attempted to calm her down.
As the report details, “Mrs. Witherspoon asked, ‘Do you know my name?’ I answered, ‘No, I don’t need to know your name.’ I then added, ‘right now.’ Mrs. Witherspoon stated, ‘You’re about to find out who I am.’”
The report also specified, “Mrs. Witherspoon also stated, ‘You are going to be on national news.’ I advised Mrs. Witherspoon that was fine.”

Toth was charged with DUI as well as failure to maintain a lane while driving. For her efforts, Reese Witherspoon was charged with “disorderly conduct (obstruction),” which is a local municipal ordinance according to Variety. Witherspoon and Toth were both released at approximately 3:30AM ET on Friday.
Toth is an agent who works for Creative Artists Agency, who in turn represents Witherspoon, who is currently in Atlanta working on the independent film The Good Lie. Production was reportedly unaffected by the arrests. Here is a synopsis of the film, which sounds like The Blind Side with a Sudanese rufugee instead of a poor football player:
The Good Lie follows a young refugee of the Sudanese Civil War who wins a lottery for relocation to the United States with three other lost boys. They develop an unlikely friendship with a brash American woman, played by Witherspoon, but the young man struggles to adjust to his new life and his feelings of guilt about the brother he left behind.
