BREAKING Dark Knight Rises shooter James Holmes initial court appearance

James Holmes had his arraignment hearing this morning for his alleged attack at a midnight showing of The Dark Knight Rises that resulted in the death of 12.

Following this hearing the district attorney’s office run by Carol Chambers will have 72 hours from the hearing to file formal charges. In addition this hearing also provided the first look at Holmes’ lawyers who had yet to be identified.

• Holmes has been charged with First Degree Murder

• Holmes is being secured on a no-bail hold

• By all appearances he looked sedated during the brief hearing

• Holmes was ordered not to contact any of the victims or their families

Only one person has received the death penalty in the state of Colorado since the 1960′s. The state does allow for this sentence in situations where there’s “aggravating factors” such as instances where a defendant knowingly created a grave risk of death for multiple individuals or when crimes are deemed to be especially heinous, atrocious, cruel, or depraved.

The DA will have 60 days to let the judge know if they will be seeking the death penalty in this particular case.

I usually do not support the death penalty because of the chance of killing an innocent person. But seriously, fry him.

But actually the DA office has a week and not 72 hours because they asked for extra time or something along those lines and they will decided if they are perusing the death penalty 60 days from a different court date, just to let you know this is what she said on a local new interview.
Thank you do much for reporting on this, I am devistated knowing what happen to my home town, down the road where I grew up, it’s very meaningful that so many people are showing support.

I’ve always been undecided on the death penalty. It seems wrong to punish someone for killing another by killing that person. Then again, some people will never change. I’m sure whether they hand down a death sentence or not, he’s going to be dead. He doesn’t seem like could survive prison.

he will be tortured in prison. especially since one of his victims was a child. guys in prison don’t look to kindly on others that have done harm against a child. even criminals have some moral standards sometimes. i hope he’s so miserable in prison that he begs to die.
and i hope it lasts for years and years. death would be the easy way out for him. he needs to suffer every day for what he has done.

I was born and raised in CO. Been to Aurora many times and a few of my friends live there. One one hand, I would like to see him get the death penalty but not just do the injection, I would want him to suffer and feel pain for all the pain he caused on these people. On the other hand, why give him the death penalty? Why not let him rot in prison the rest of his life?

Most likely though it will be the death penalty. His lawyers will probably try the insanity plea but c’mon he had this all planned out with booby trap bomb type contraptions in his apartment, buying over 6,000 rounds of ammo, 4 guns, and various other things. He was sane and he wanted to create a grave risk for death for multiple individuals and did this act in a horrid and evil way. Plus he had the booby traps set up in his apartment to go off when somebody came inside. I’m more than willing to be he was wanting to create a distraction with the explosion in his apartment complex and do more damage than he did at the movie theater while medical and police officials were distracted. It was his MISSION to do this. I hope he suffers.

  This guy is most likely a paranoid schizophrenic. Just because he’s mentally ill doesn’t mean that he doesn’t have the ability to meticulously plan. You pretty much HAVE to be “insane” to do something like this. An insanity plea would make sense here seeing as he is clearly disturbed, but it’s definitely not going to get him off the hook.
  
  Even if he suffers as he rots in prison, as I hope he does, he will most likely never understand what he has done.

    I agree. This guy is definitely insane. I don’t think normal healthy sane individuals do things like this, ever. But he needs to suffer consequences for the sake of the victims families. Its awful people didn’t intervene before this happened. How did no one know? Regardless, a death penalty judgement is the closest thing to “justice” and therefore is deserved.

The death penalty is absolutely pointless. It gives criminals like him the easy way out and really isn’t a punishment at all. No one knows for certain what happens after death, and there’s no guarantee with a death penalty that he will SUFFER for his crime. If he is imprisoned for life, we know for a fact that he will suffer. He will have to live with what he did, and he will be tortured by others for what he did, and that’s what should happen. He shouldn’t get the easy way out by being killed. Even if the death he’d face would be a painful death instead of injection, that suffering wouldn’t last long enough. He needs to suffer for life. Not to mention, killing for killing doesn’t send a proper message. Also, death penalty is MUCH more expensive than imprisonment for life, believe it or not.

  I don’t want him to suffer for his crime. I want him to be gone from existence. I want him to not exist. It isn’t about money or what is cost effective. It isn’t about wanting him to pay for something. I want him to be that which is no longer in existence.
