Teen Mom Amber Portwood denied leniency, sentenced to 5 years in jail

Teen Mom Amber Portwood was sentenced to 5 years in jail by an Indiana judge after having requested that the courts do as much.

If you missed the previous report on Amber, she shocked her attorney and the court by requesting to be re-sentenced. Her original sentencing stemming from her physical assault of Gary Shirley, which was aired on MTV, was for five years but she was shown leniency by the courts at the time.

She was given the option to complete a drug court rehabilitation program as part of a plea agreement to avoid jail but it proved to be too much and now Portwood has received her wishes in court today.

Her attorney requested for yet another showing of leniency but the judge was having none of it acknowledging that he had no choice but to enforce the terms of the prior plea agreement.

Amber will be given credit for time served. The judge has referred Portwood to the Indiana Department of Corrections therapeutic community program which is an incarceration-based treatment program.

Our thoughts are with Amber and her family, especially her daughter Leah and we’re hoping that through all of this Amber will receive the help she needs and be able to one day lead a healthy and productive life.

Sending all my love to that little baby girl. Having been a child of a parent in and out of prison myself, she’s going to need so much support, love and therapy. It’s so easy to lose your innocence and childhood, you grow up so fast with all this on your mind. Gary really needs to step up and give her a beautiful, normal and stress free life.

I did not see this coming when her 16&P season aired. :(

I am happy in a sense that Amber is going to prison because then maybe she will finally wake up and stop abusing drugs. However, my heart truly breaks for Leah. She does not deserve to grow up without her Mom. I would never wish that on any child and I can only hope that Gary does the right thing and keeps Leah out of it.

Despite Amber’s problems and her request to be placed in prison my heart goes out to Leah, Gary and the rest of the family. Prison takes a toll on a family. They have a difficult road ahead. Blessings.

I was genuinely upset when I read this, mostly & obviously for Leah!! She is growing up to be a sweet beautiful little girl and deserves to have a mother their to love and appreciate her!! I’m also so sad for Amber as well, she has made A LOT of mistakes and I honestly believe she is mentally ill and instead of prison she needs some serious help for her mental state. No person in their right mind would ask to go to prison and miss out on 5 years of their daughters life.

I hope to God that this poor girl straightens herself out before its too late. I think she should be on suicide watch in prison bcos she is so obviously very unstable!!!

Good luck to Gary, Leah & Amber xxx

        Ah. Good point

A five year prison sentence means she will probably be eligible for parole in about six months. Not really that big of a deal.

      • Pam

It depends on the state law. Where I am from if your probation is revoked for whatever reason then you have to serve your full(or at the least half) sentence. She could get an early release after serving 2 of a 5 year sentence. If the court allows it.

      Finally!!

what’s with all the thoughts and prayers for amber? she’s a piece of crap. she’s choosing jail over being sober and being in her daughters life. makes me sick.

      • LOL

You clearly don’t know much about addiction. or if you do,you’re heartless.

      • Alyssa

Read the posts, people are sending out thoughts and prayers to Leah. She’s choosing jail because she can’t lead a sober life outside of prison. Prison has some drug and alcohol programs that she will be forced to attend. In a way this is her crying for help.

    • LisaM

Thank god….How pathetic to choose jail over recovery and not being able to see your child.

      • misty

you should learn more about addiction, and what it does to a persons body and mind before you start posting ignorant comments.
i find you quite pathetic to post this before educating yourself ;-)

    • damn

What mother would choose this life for her child? Who would choose a motherless life over even trying to get clean for her child?

    • Ihatestich

      She.asked for it …literally!

    • D

I understand that Amber is basically saying this is her last resort to clean up. In prison, she HAS to be clean. She keeps giving in to temptation and doesn’t feel strong enough to be out in the world yet. Hopefully in a few years she will be in a much better place in life.

Jenelle’s turn! These teen (absent) mom’s think they’re above the law! Honey you’ve been to jail, sneek preview of prison, if you didn’t want to end up there you should have followed thru with what the court ordered!

    • Bailey

Very brave of Amber. Prison will give her the hard kick in the arse she needs to become sober and rehabilatate herself. She obviously understands that her freedom is her devil, and being forced to become sober in state prison is maybe her only option. Amber has never brought drama upon herself in the media unlike Jenelle and some of the others.
My best wishes go out to Gary and Leah xxooxxoo

Starcasm, prison and jail are different things. Amber was sentenced to 5 years in PRISON. Jails are run on a county level and hold people with sentences of less than one year or those awaiting trial (with some exceptions). Sorry this is a pet peeve of mine!

      • Caroline

I was curious if Amber has ever been to prison? and if that is where she is going. I didn’t know the difference in jail and prison for a long time and at least in my state there is a huge difference.Jail is like a hotel compared to prison. I hope Amber knows what she is committing herself to for 5 years if it is prison and she has never been there.

        • Lisa

No, she has never been to prison, only County Jail. Prisons are run by states or the federal government housing people with felony convictions and typically a sentance of greater than one year. However with good time/good behavior credit most only serve a little more than half their sentance. That varies depending on type of conviction (i.e violent felonies are often required to serve 80%).

Since there is more of a “community” in womens prison I think she will be ok however, getting out of the prison mentality is hard especially after several years. Good lcuk to her.

    • Sherita

I think Amber thought that she was not gonna be sent to Prison and that the judge would see her request as a cry for help and give her more intemsed treatment outside of prison. Well, the joke was on her this time. I dont think I could choose prison for yrs over seeing my child. Here to hoping she gets herself together and that Leah wont be fu**ed up from all this.

This will have the biggest effect on Leah – growing up without a mom, especially one who’s in prison. Let’s hope Leah doesn’t turn out like her.
